The Association has a history of failing to comply with information requests, especially those from Homeowner X. Their excuse is that they are unpaid and have other priorities. However, the law states that directors and officers of the Association should not accept their positions if they do not intend to fulfill their obligations.
The Board appears to believe that they can arbitrarily choose which homeowners' requests they must respond to. However, any homeowner can designate an adult of legal age to make requests on their behalf, and there is no legal basis for ignoring or refusing such requests.
Given that the unelected 2023 Board now has installed a lawyer as Vice President and is using DANA Properties for administrative tasks, it will be interesting to see how they continue to refuse to provide requested information. Honest people engaged in legitimate activities do not go to such lengths to conceal their actions.
