Judith Pierce and her husband David, an El Paso attorney, have been accused of waging a years long campaign of harassment and oppression against her neighbor in the El Mirador Homeowners Association (EMHA) subdivision of Santa Teresa, New Mexico. Additionally, it is alleged that she, and her husband, are acting as surrogates for the Association, coordinating through Henry Trost. EMHA Design Review Committee Chair and member of the Board of Directors.

While Judith's intentions are unclear, it has been established that she told several homeowners, and some of their guests, that her in-laws had purchased or would purchase (different persons were told different versions) the property located at 233 Avenida Mirador. These statements apparently were made both prior to and as recently as a year after the current homeowner actually purchased the property. The actual owner contends that perhaps Pierce, in collusion with Trost, originally intended for the homeowner to move, but now her intentions are simply spiteful vindictiveness.

What is indisputably clear is that the Pierce's behavior is completely unwarranted and inappropriate. If she has a reason for behaving in this way she has made no effort to communicate it to the homeowner, preferring instead vitriol and abject hatred.


WHISPER CAMPAIGN

The homeowner, who has been the object of Pierce's ire, contends that he has reason to believe that Pierce has engaged in a great deal of rumor-mongering; carrying out a whisper campaign among at least some Association membership. Any persons reading this with certain knowledge can contact us via email or phone and relate your information.

The purported whisper campaign would be for the purposes of generally defaming the homeowner and to elicit feelings of ill will among the Association members. It is also claimed that the whisper campaign sought to convince other homeowners to file complaints with EMHA against her neighbor, as a means of using surrogates in her stead to make her accusations appear to be valid.

SURROGATE FOR EMHA

The assertion that the Pierce's are acting as EMHA surrogates involves, among other things, specific information provided to them by the Association through an intermediary, Henry Trost. The homeowner insists that Trost has, over the past 18 months to two years, given the Pierces copies of Association documents from the homeowner to the Association, and regarding the Association's legal matters that involve the specific neighbor. This demonstrates a collusive effort between the Pierces and EMHA, to create a hostile environment, against the homeowner.

As recently as January 28, 2021, the homeowner claims that Trost delivered to Judith Pierce a letter the homeowner sent to EMHA President Richard Doyle, a few days prior, via certified mail.


All EMHA Board and Committee members, as a fiduciary duty, have a responsibility to take reasonable precautions to protect members' confidential information. In this case, against this specific homeowner, it appears that this duty has been breached by, at least, the President and Design Review Committee Chair, and possibly the Secretary/Treasurer, knowingly and deliberately providing the information to hostile third-parties, David and Judith Pierce.

In one incident, the homeowner alleges that Judith, as EMHA surrogate, is preparing to make a "complaint" to EMHA about a specific homeowner's lighting. Previously, the homeowner had requested to install lighting, but was denied by Timothy Hinker and Henry Trost, who claimed, in bad faith, that the Association had adopted new lighting rules which excluded his exterior lighting. Hinker and Trost later lied about telling the homeowner that any new rules had been adopted, but the homeowner recorded the meeting and has evidence.

The homeowner asserts that the Association deliberately intended to deny him the ability to install exterior lighting, and that the Pierce's involvement would allow EMHA to fine the homeowner due to an anonymous "neighbor complaint". The entire situation, according to the homeowner, was contrived and orchestrated between the Association leadership and the Pierce's. In addition to photographic, video and audio evidence the homeowner has gathered, he is confident that telephone records and likely emails exist that will further corroborate communication and collusion between the parties.
