Public records confirm that years ago, Pena went through a divorce from a previous marriage during the timeframe of a rumored infidelity incident, in which he allegedly caught his spouse in bed with another man. He has since remarried. His name also appears on a slanderous document distributed to all El Mirador HOA members, published by DANA Properties representative Sema Gonzalez, further contributing to the defamation of Homeowner X and their family.
HOA directors and officers inherently become public figures by virtue of their political campaigns seeking these roles and their subsequent installation as directors or officers. Their decisions and actions significantly impact entire communities, making their conduct subject to public scrutiny. In cases like those involving DANA Properties, the appointment of individuals to these positions often reflects broader organizational agendas, further underscoring their public accountability.

Not only is Pena’s driveway inconsistent with his personal rule regarding front yard driveways, it violates Design Review Guideline § 2.2.16, which explicitly states: “Concrete shall be the only material allowed in constructing driveways in the Subdivision.” Pena’s front-yard driveway is made of chat, a material that is explicitly non-compliant with the Guidelines, further emphasizing his disregard for the rules he enforces on others.
